Welcome to 5Boys Apparel. These Terms of Service ("Terms") govern your use of our website at 5boysapparel.com and your purchase of custom screen printing and embroidery services. By using our website or placing an order, you agree to these Terms.

By accessing our website or placing an order, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are placing an order on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Orders and Pricing
Order Acceptance
All orders are subject to acceptance by 5Boys Apparel. We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Errors in pricing or product information
- Artwork that infringes on intellectual property rights
- Artwork containing illegal, offensive, or inappropriate content
- Suspected fraudulent activity
Pricing
All prices are listed in U.S. dollars. Prices are subject to change without notice. The price charged for your order will be the price displayed at the time of order confirmation. Our package prices include:
- Blank garments as specified
- Screen printing or embroidery (up to specified print locations/colors)
- Free shipping within the continental United States
- Free digital proof for approval
Payment
Full payment is required before production begins. We accept major credit cards, PayPal, and other payment methods as displayed at checkout. For orders over $2,500, we may offer payment plans on a case-by-case basis.
3. Artwork and Proofs
Artwork Requirements
You are responsible for providing print-ready artwork or working with our design team to create suitable artwork. Acceptable file formats include: AI, EPS, PDF, PNG (high resolution), and PSD.
Proof Approval
Once a proof is approved:
- No changes can be made without potential fees and production delays
- You assume responsibility for any errors in the approved design
- Production will begin
Design Services
We offer free basic design assistance. Complex designs or extensive revisions may incur additional fees, which will be communicated before work begins.
Complex & Detailed Designs
Screen printing and embroidery have technical limitations. If our team identifies concerns with extremely detailed artwork (fine lines, small text, intricate gradients, high color counts), we will notify you. If you choose to proceed after being notified of potential issues, you accept responsibility for the final output and no refunds or reprints will be issued for quality issues related to the identified concerns.
4. Production and Shipping
Production Time
Standard production time is 17-24 business days after proof approval. Production times do not include shipping transit time.
Shipping
We provide free ground shipping on all package orders within the continental United States. Typical transit times are 1-7 business days depending on location. Expedited shipping is available at additional cost. International shipping is available on request.
Shipping Address
You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by customers. Reshipping to corrected addresses will incur additional shipping charges.
5. Returns and Refunds
Custom Products - All Sales Final
Because all products are custom-made to your specifications, all sales are final once production begins. We cannot accept returns or provide refunds for orders that match the approved proof.
Manufacturing Defects
We will address manufacturing defects only — issues caused by our production process. If you receive an order with a manufacturing defect, contact us within 48 hours of delivery with photos. We will, at our discretion, reprint the affected items or provide store credit.
Cash Refunds
Cash refunds are considered on a case-by-case basis only. If approved, a shipping cost recovery fee of $25 per 100 garments (or portion thereof) will be deducted from any cash refund. See our full Return Policy for details.
6. Intellectual Property
Your Artwork
You retain all rights to artwork you provide. By submitting artwork, you grant us a limited license to use it solely for fulfilling your order.
Your Representations
By submitting artwork, you represent and warrant that:
- You own the artwork or have the right to use it
- The artwork does not infringe on any third party's intellectual property rights
- You have necessary permissions for any logos, trademarks, or copyrighted material
Prohibited Content
We reserve the right to refuse to print content that:
- Infringes on trademarks, copyrights, or other intellectual property
- Contains hate speech or promotes violence
- Is illegal, obscene, or defamatory
- Promotes illegal activities
Indemnification
You agree to indemnify and hold 5Boys Apparel harmless from any claims, damages, or expenses arising from your artwork, including intellectual property infringement claims.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 5BOYS APPAREL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS.
Our total liability for any claim arising from an order shall not exceed the amount you paid for that order.
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, supplier issues, shipping carrier delays, or other force majeure events.
8. Disputes and Governing Law
These Terms are governed by the laws of the State of Alabama. Any disputes arising from these Terms or your orders shall be resolved in the state or federal courts located in Madison County, Alabama.
Before initiating any legal action, you agree to contact us to attempt to resolve the dispute informally.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

Return & Refund Policy

Custom Products - All Sales Final
Because every order is custom screen printed or embroidered specifically for you, we cannot accept returns, exchanges, or provide refunds for completed orders that match the approved proof. This includes:
- Orders that match the approved digital proof
- Sizing issues — size charts are provided; please measure carefully before ordering
- Color variations between your screen display and the actual print
- Buyer's remorse, change of mind, or orders no longer needed
- Spelling, grammar, or design errors present in the approved proof
- Garment color or style choices you made during ordering
- Issues reported more than 48 hours after delivery
Proof Approval is Final
We strongly recommend:
- Having multiple people review the proof before approval
- Checking all spelling and text carefully
- Verifying size quantities match your needs
- Reviewing color selections
Manufacturing Defects Only
We will address manufacturing defects only — issues caused by our production process, not customer decisions or preferences. Manufacturing defects include:
- Significant misprints that clearly deviate from the approved proof
- Ink defects: bleeding, smearing, or missing portions of the print
- Incorrect print placement (more than 1" from proof specification)
- Garments with holes, tears, or stains present on delivery (not from shipping damage)
- Wrong items shipped (different product than ordered)
What is NOT a Manufacturing Defect
- Minor color variations (±10% is industry standard)
- Slight placement variations (within 1" is acceptable)
- Garment shrinkage after washing (follow care instructions)
- Print wear after washing or extended use
- Differences between how colors appear on screen vs. on fabric
- Thread color variations in embroidery (thread dye lots vary)
Reporting Issues
If you believe you received a defective product:
- Contact us within 48 hours of delivery — issues reported after 48 hours will not be considered
- Email sales@5boysproductions.com with:
- Order number
- Clear, well-lit photos showing the defect
- Photo of the garment tag/label
- Description of the specific issue
- Our team will review within 2 business days
Claims without photo documentation will not be processed.
Resolution for Valid Defects
If we determine a manufacturing defect occurred, resolution is at our sole discretion and may include:
- Reprint of affected items only — we will remake only the specific defective pieces, not the entire order
- Partial credit — store credit for the defective portion may be offered
- Partial refund — in limited cases, a refund for defective items only
We reserve the right to require return of defective items before processing any replacement or refund. Return shipping for verified defects will be provided.
Resolution Limits
- Maximum resolution value is limited to the cost of the defective items, not the entire order
- We do not reimburse for event cancellations, lost business, rush fees paid elsewhere, or other consequential damages
- Resolution is limited to one attempt — if a reprint is provided and matches the proof, no further resolution will be offered
Order Cancellation
- Before proof approval: Orders may be cancelled for a full refund minus a $25 processing fee
- After proof approval: Orders cannot be cancelled — production begins immediately upon approval
- Orders in production: No cancellations or refunds once production has started
Complex Design Cancellation
If we notify you that your design may not produce well due to complexity (fine lines, small text, high color counts, intricate details) and you choose to cancel rather than proceed or modify the design, a cancellation fee will apply:
- $100 or 20% of the order total, whichever is greater
This fee covers the time invested in artwork review, screen preparation, and production scheduling.
Shipping Damage
If your package arrives visibly damaged:
- Document the damage with photos before opening
- Note the damage with the carrier if possible
- Contact us within 24 hours of delivery
Shipping damage claims are handled through the carrier. We will assist with filing claims but cannot guarantee carrier reimbursement.
Lost Packages
Once a package shows "Delivered" by the carrier's tracking, 5Boys Apparel is not responsible for lost or stolen packages. We recommend:
- Using a secure delivery address
- Requiring signature confirmation for large orders (available at checkout)
- Filing a claim directly with the carrier for missing packages
Exchanges
We do not offer exchanges on custom products. If you need additional or different items, a new order must be placed.
Refund Processing
Cash Refunds
Cash refunds are considered on a case-by-case basis only. We are not obligated to provide cash refunds and may offer store credit or reprints as alternatives at our sole discretion.
If a cash refund is approved, the following shipping cost recovery fee will be deducted from the refund amount, as all orders include free shipping which we cannot recover once an order has been delivered:
- $25 per 100 garments (or portion thereof)
Examples:
- 1-100 garments: $25 deducted from refund
- 101-200 garments: $50 deducted from refund
- 201-300 garments: $75 deducted from refund
- And so on...
This fee reflects the actual shipping costs we incurred to deliver your order at no charge.
Refund Timeline
Approved refunds are processed within 7-10 business days. Refunds are issued to the original payment method. Bank processing times may add 5-10 additional business days.

Production Time
All orders are custom screen printed or embroidered to your specifications. Standard production time is:
- 17-24 business days after proof approval
- Business days are Monday-Friday, excluding federal holidays
Complex & Detailed Designs
Screen printing and embroidery have technical limitations. Designs that are extremely detailed, have very fine lines, small text, intricate gradients, or high color counts may not reproduce well in production.
If our team identifies concerns with your artwork:
- We will notify you of potential production issues before proceeding
- We may recommend design modifications for optimal results
- If you choose to proceed with a complex design after being notified of potential issues, you accept responsibility for the final output
Cancellation After Design Notification
If you wish to cancel your order after we have notified you of design complexity issues (rather than proceeding or modifying the design), a cancellation fee will apply:
- $100 or 20% of the order total, whichever is greater
This fee covers the time invested in artwork review, screen preparation, and production scheduling.

- Alabama, Georgia, Tennessee, Mississippi: 1-2 business days
- Southeast US: 2-3 business days
- Midwest & Northeast: 3-5 business days
- Mountain & West Coast: 5-7 business days
Transit times are carrier estimates and are not guaranteed.
Expedited Shipping (Additional Cost)
Need faster shipping? Contact us for expedited options:
- 2-Day Air: Available for most destinations
- Overnight: Available for urgent orders
Expedited shipping rates vary by location and package weight. Contact us at (256) 809-0780 for a quote. Note: Expedited shipping does not reduce production time.
Rush Orders
Need your order faster than standard production time? Rush production may be available for an additional fee. Rush availability is subject to:
- Current production schedule and capacity
- Artwork readiness and complexity
- Blank garment availability
Contact us before placing a rush order to confirm availability and pricing. Rush fees are non-refundable. Even with rush production, we cannot guarantee specific delivery dates.
Order Tracking
Once your order ships, you'll receive an email with tracking information. You can track your package using the provided tracking number on the carrier's website.
Shipping Carriers
We ship via:
- UPS
- FedEx
- USPS
Carrier selection is at our discretion based on destination, package size, and service availability.
Delivery Issues
Lost or Stolen Packages
Once a package shows as "Delivered" by the carrier's tracking system, 5Boys Apparel is not responsible for lost, stolen, or missing packages. We strongly recommend:
- Providing a secure delivery address where someone can receive the package
- Using a business address or shipping locker if available
- Adding signature confirmation for valuable orders (available at checkout)
- Tracking your package and being available on the expected delivery date
If your package is missing, file a claim directly with the shipping carrier.
Damaged in Transit
If your package arrives visibly damaged:
- Take photos of the damaged packaging and contents immediately
- Note the damage with the delivery driver if possible
- Contact us within 24 hours of delivery with photos
We will assist with filing carrier claims but cannot guarantee reimbursement from carriers.
Incorrect Address
You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by the customer. If an order is returned due to an incorrect, incomplete, or undeliverable address:
- You will be responsible for reshipping costs
- Unclaimed packages returned to us may incur storage fees
- Packages not claimed within 30 days may be considered abandoned
PO Boxes
We can ship to PO Boxes via USPS for smaller orders. Larger orders requiring freight shipping cannot be delivered to PO Boxes. Please provide a physical address for large orders.
International Shipping
We offer international shipping on a case-by-case basis. International orders:
- Require a custom quote — contact us for pricing
- Are subject to customs duties, taxes, and import fees (buyer's responsibility)
- Have longer transit times (typically 10-30 business days depending on destination)
- May have limited tracking once the package leaves the US
- Are non-refundable once shipped due to customs complexities
Split Shipments
Large orders may ship in multiple packages or on multiple days. You'll receive tracking for each shipment. Partial shipments do not indicate an incomplete order unless items are missing from the final shipment.
Delivery Date Disclaimer
To reiterate: We do not guarantee delivery by any specific date. Production and shipping estimates are provided in good faith based on typical timelines but are subject to change. Factors including (but not limited to) artwork revisions, blank garment availability, production volume, carrier delays, weather, and other circumstances may affect timing. By placing an order, you acknowledge and accept that delivery dates are estimates only.
